Terms of Use

Please read these Terms of Use carefully before using CalzAI. By downloading or using the app, you agree to be bound by these terms.

1. Acceptance of terms

These Terms of Use ("Terms") form a legal agreement between you and Axain Studios ("we", "us", or "our") governing your use of the CalzAI mobile application ("the app"). If you do not agree to these Terms, do not download or use the app. If you are using the app on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. License to use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use CalzAI on Apple devices that you own or control, solely for your personal, non-commercial use, in accordance with the App Store Terms of Service.

3. Nature of estimates

CalzAI identifies food from photographs — using either on-device processing or, by default, a cloud AI service (see the Privacy Policy) — and calculates nutritional values from a bundled nutrition database. These results are approximations. Food recognition may be incorrect, and calorie and macronutrient figures depend on portion size, preparation, ingredients, and other factors the app cannot observe. Values shown (for example, "~532 kcal") are estimates only and should not be relied upon for precise dietary or medical purposes.

4. No medical or professional advice

CalzAI is a wellness and informational tool. It is not a medical device and does not diagnose, treat, cure, or prevent any disease or condition. Nothing in the app constitutes medical, nutritional, dietary, or professional advice. You should consult a physician, registered dietitian, or other qualified healthcare provider before beginning any diet, nutrition, or weight-management program, and before relying on any information provided by the app. If you have or suspect a medical condition or eating disorder, seek professional help. Never disregard professional advice because of something in the app.

5. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code or models of the app, except where permitted by law;
• Use the app for any unlawful purpose or in violation of any applicable regulation;
• Interfere with, disrupt, or attempt to gain unauthorized access to the app or related systems;
• Resell, redistribute, or commercially exploit the app or its content without our written permission.

6. Subscriptions & payment

CalzAI is free to download and includes a free tier that allows a limited number of food scans per day. Unlimited scanning and premium features are available through an auto-renewable subscription ("CalzAI Pro"), offered in the following options:

• CalzAI Pro Monthly — billed every 1 month.
• CalzAI Pro Quarterly — billed every 3 months.
• CalzAI Pro Yearly — billed every 12 months.

Each option may include a 1-week free trial for eligible new subscribers. The exact price and billing period for your region are shown in the app before you confirm any purchase, and on the App Store product page.

The following terms apply to auto-renewable subscriptions, consistent with Apple's requirements:

• Payment is charged to your Apple ID account upon confirmation of purchase.
• Your subscription automatically renews for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
• If a free trial is offered, any unused portion of the free trial is forfeited when you purchase a subscription during that trial.
• You can manage or cancel your subscription, and turn off auto-renewal, in your device's Settings → [your name] → Subscriptions after purchase.

All purchases are processed by Apple and are subject to Apple's terms, including the Apple Media Services Terms and Conditions, which serve as the end-user license agreement (EULA) for auto-renewable subscriptions. Refunds, where applicable, are handled by Apple in accordance with its policies; we do not process payments or issue refunds directly.

7. Intellectual property

The app, including its design, code, models, nutrition data compilation, trademarks, and content, is owned by Axain Studios and its licensors and is protected by intellectual property laws. Except for the license granted above, no rights are transferred to you. The data you create within the app (such as your meal diary) belongs to you.

8. Third-party services

The app uses Apple frameworks and services, including StoreKit, HealthKit, and the App Store. When Cloud AI food recognition is enabled (the default), a compressed photo is processed by Google's Gemini API to identify the food, as described in our Privacy Policy. Your use of those services is subject to the applicable third party's terms and privacy policies, and we are not responsible for the practices of third parties. CalzAI does not display third-party advertising.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT FOOD RECOGNITION OR NUTRITIONAL ESTIMATES WILL BE ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AXAIN STUDIOS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Axain Studios and its officers, employees, and agents from any claims, damages, liabilities, and expenses arising from your misuse of the app or your violation of these Terms.

12. Termination

These Terms remain in effect while you use the app. You may end this agreement at any time by deleting the app. We may suspend or terminate your access if you violate these Terms. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitations of liability — will survive.

13. Governing law

These Terms are governed by the laws applicable in the jurisdiction in which Axain Studios operates, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of that jurisdiction, unless mandatory consumer-protection laws in your country of residence provide otherwise.

14. Changes to these terms

We may modify these Terms from time to time. When we do, we will update the "Last updated" date above and reflect the changes in an updated app release. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.
